Immigration

The enforcement of immigration laws is the responsibility of the federal government, specifically the U.S. Immigration and Customs Enforcement (ICE). The Fitchburg Police Department does not routinely ask about a person’s immigration status and does not begin investigations based only on someone’s immigration status.

We are committed to providing fair, impartial service to everyone in our community. All individuals – regardless of background, national origin, or immigration status – can contact us to report a crime, ask for help, or access services.

Public safety is a shared effort built on trust. Our goal is to partner with the community to ensure everyone feels safe and respected. This reflects our mission to “Serve and Respect.”

Immigration Enforcement and 287(g) Agreements

Section 287(g) agreements under 8 U.S.C. § 1357 are voluntary agreements that allow local law enforcement agencies to assist with certain federal immigration enforcement duties.

The Fitchburg Police Department will not enter into 287(g) agreements, as they are not consistent with our community-focused policing philosophy.

Federal Requests for Assistance

If federal immigration officials request assistance, the request must first be reviewed by a supervisor.

In most cases, our role is limited to support functions such as traffic control or maintaining public safety at a scene.

The Department may assist more directly only when there is a clear public safety concern. This could include helping detain someone, sharing relevant information, or coordinating on a person’s release. Examples of these situations include when an individual:

  • Is suspected of terrorism or espionage
  • Is believed to be involved in a transnational criminal street gang
  • Has been arrested for a violent felony
  • Has been arrested for a sexual offense involving a minor
  • Is a previously deported felon
  • Has been arrested for another serious felony that poses a significant threat to public safety

  • Ensures equal enforcement of the law and equal access to services
  • Recognizes that immigration enforcement is a federal responsibility
  • Provides guidance when immigration-related warrants are encountered during normal duties
  • Explains when the Department may communicate or share information with federal authorities
  • Provides guidance for handling U and T Visa requests
